Objection to release of student data -- due April 1, 2016

The California Department of Education (CDE) was ordered by a Federal Court on Jan. 25, 2016 to produce personally identifiable information related to all students who have attended a California school since Jan. 1, 2008. This production will be subject to a Protective Order and the information will not be made public.

If you are a parent or guardian of a potentially affected student (or you are a person over the age of 18 who is attending or attended a California school at any time since Jan. 1, 2008), however, you may send the court an objection to the production of your child’s records (or your own records). This objection must be made by mail and must be received by the court no later than April 1, 2016. The Objection Form and further information is available in both English and Spanish on the CDE’s website at: http://www.cde.ca.gov/morganhillcase. A failure to object will result in the CDE producing the requested information.*

The Fresno County Office of Education is not a party to this lawsuit and is not required to disclose any student information, and does not intend to. * Please note: The Court has further clarified filing an objection form does not act as an automatic opt-out. Also, the Court has stated no CALPADS longitudinal date will automatically be produced.
